amarre

terms and conditions

Last updated: [date] · Effective: [date]

Welcome to amarre. These Terms and Conditions (“Terms”) are a binding agreement between you and [amarre legal entity name, S.A.P.I. de C.V.], with its registered address at [address, Zapopan/Guadalajara, Jalisco, Mexico] (“amarre,” “we,” “us”). They apply to the amarre mobile app, website and related services (the “Service”).

Please read them carefully. If you are in the United States, Section 18 contains a binding arbitration agreement and class-action waiver, which you can opt out of within 30 days. Nothing in these Terms limits rights you have under mandatory consumer laws where you live.

1. Accepting these Terms

By creating an account or using the Service, you agree to these Terms, our [Privacy Notice / Aviso de Privacidad], our [Community Guidelines] and our [Safety Tips]. If you do not agree, do not use the Service. If you are in Mexico, the Spanish version of these Terms controls.

2. Eligibility

To use amarre you must:

  1. Be at least 18 years old (or the age of majority where you live, if higher).
  2. Be legally able to enter into a binding contract.
  3. Not be barred from using the Service under the laws of your country.
  4. Not have been convicted of, or pleaded guilty or no contest to, a felony, any crime involving violence, or any sexual offence, and not be required to register as a sex offender anywhere.
  5. Not have been previously removed from amarre for violating these Terms, unless we have given you written permission.

We use age-assurance tools, which may include facial age estimation or ID checks, to confirm eligibility. If we believe you are under 18, we will suspend your account and delete your data except where we must keep it by law.

3. Your account

  • You are responsible for keeping your login credentials confidential and for activity on your account.
  • You may hold only one account. Your information must be accurate, current and your own.
  • Verification. We may offer or require photo verification. If verification uses facial geometry or other biometric data, we will ask for your separate, explicit consent first, explain how long we keep it, and offer an alternative where the law requires one. Verification does not guarantee anyone’s identity.
  • You can delete your account at any time in [Settings > Account > Delete account]. Deleting the app does not delete your account. Section 11 explains what happens to unused dalias.

4. Your privacy

Our [Privacy Notice / Aviso de Privacidad] explains what personal data we collect, why, who we share it with, how long we keep it and how to exercise your rights. Key points:

  • Sensitive information. Information such as your sexual orientation, gender identity, religion, ethnicity, health status or biometrics is sensitive. Giving it is optional (except where needed for verification, which we will tell you about), and we process it only with your explicit consent. You can withdraw consent at any time in [Settings > Privacy].
  • Bookings and location. To book and check in to dates we process your location, the venues you book, your attendance and your dalias transactions. We share only what a venue needs to honour your booking [e.g. first name and booking time].
  • Your rights. Depending on where you live, you can access, correct, delete, port or object to the processing of your data, and opt out of targeted advertising or “sale/sharing” (US), or exercise your ARCO rights (Mexico). These requests are free. Contact [privacy@amarre.app].
  • No sale of sensitive data. We do not sell your personal data, and we never use sensitive data to target advertising.
  • International transfers. amarre operates from Mexico and uses service providers in [countries]. When we transfer your data across borders we use the safeguards required by your local law, such as Standard Contractual Clauses for the EU.

5. Community rules

You agree not to:

  1. Harass, threaten, stalk, intimidate, defame or abuse anyone.
  2. Post or send nudity, sexually explicit content, or sexual messages to someone who has not agreed to receive them.
  3. Share or threaten to share intimate images of anyone without their consent, including AI-generated or altered images (“deepfakes”).
  4. Post anything involving minors in a sexual context. We report child sexual abuse material to the authorities.
  5. Impersonate anyone, use someone else’s photos, or misrepresent your identity, age or relationship status.
  6. Solicit money, run scams, romance fraud, investment or crypto schemes, or ask for financial information.
  7. Advertise, promote commercial services, or engage in prostitution, escort services or human trafficking.
  8. Post hate speech or content that promotes violence or discrimination based on race, ethnicity, religion, disability, gender, gender identity, sexual orientation or similar characteristics.
  9. Use bots, scrapers or automated means to access the Service, or reverse engineer it.
  10. Share another user’s personal information or screenshots of private conversations without consent.
  11. Abuse bookings: book with no intention of attending, use fake check-ins, or harass venue staff.
  12. Use the Service for any illegal purpose.

6. Your content

  • You own your content. You keep ownership of the photos, text and other content you post (“Your Content”).
  • Licence to amarre. You give us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce, adapt (for example, resize or compress) and distribute Your Content solely to operate, improve and promote the Service within the app. This licence ends when you delete the content or your account, except for content other users already received in chats, backups kept for a limited period, or content we must keep by law.
  • Your promises. You confirm you have the right to post Your Content and that it does not violate anyone’s rights or these Terms.
  • Content from others. Other users’ content belongs to them. Do not copy or share it outside the Service.

7. Safety

Getting to know someone through an online dating service may be risky. Use caution when sharing personal information. Bookings through amarre take place in public partner venues; read our [Safety Tips] before any date.

  • Always free. Reporting, blocking, check-in and all other safety features are free and never depend on your dalias balance or payment status.
  • Background checks. amarre does not conduct criminal background checks on its users [or: describe the checks you run]. We may review profiles against public sex-offender registries where the law allows.
  • Reporting. You can report a profile, message, booking or behaviour in the app at any time; from an active booking, incident reporting is reachable in two taps. If you are in immediate danger, contact local emergency services (911 in Mexico and the US, 112 in the EU, 000 in Australia).
  • Fraud ban notices. If we remove an account for fraud and you interacted with it, we will notify you, as required by law in some places.
  • Intimate images. If an intimate image of you was shared without your consent, report it at [link/email]. We remove valid reports within 48 hours or sooner.
  • Your responsibility. You are responsible for your interactions with other users, online and offline. We do not supervise dates or venues, and we cannot control what other users do. This does not limit our liability where the law does not allow it to be limited (Section 16).

8. Moderation, decisions and appeals

  • How we moderate. We use a combination of automated tools (including AI classifiers and image detection) and human review to detect content and accounts that violate these Terms. Automated tools may flag content, but account bans are [reviewed by a human / describe].
  • What we may do. We may remove content, limit visibility, suspend or terminate your account, cancel pending bookings, or restrict the use of dalias.
  • Notice and reasons. When we restrict your content or account, we will tell you what we did, why, which rule applied, whether automated means were used, and how to challenge it, unless the law or safety reasons prevent us.
  • Appeals. You can appeal any moderation decision free of charge through [Settings > Help > Appeal] within 6 months. A person will review your appeal.
  • EU users may also use a certified out-of-court dispute settlement body under the Digital Services Act, or go to court.

9. How matching works, and sponsored content

amarre recommends profiles based mainly on: your stated preferences (age range, distance, gender), your location, activity on the app, and how other users interact with your profile. Profile ranking cannot be bought. You can change your preferences in [Settings > Discovery]. [If offered: You can choose a feed not based on profiling.] We do not use sensitive data you have not chosen to share for recommendations.

Partner venues and brands may pay for featured placement, such as a highlighted venue when you book or content before and after a date. Paid placements are always labelled as sponsored. We do not show advertising in matching or in chats.

10. AI features

Some features use artificial intelligence, such as [conversation starters, venue suggestions, photo selection]. We will label AI features and AI-generated content clearly. AI suggestions may be wrong; you decide what to send. We do not use your private messages to train AI models without your consent.

11. Dalias

amarre is free to use. Creating a profile, liking, matching, messaging, filters and all safety features cost nothing. The only paid feature is booking a date, which you pay for with dalias, amarre’s in-app credits.

  • Buying dalias. You can buy dalias in packs through [the App Store, Google Play and/or our payment processor]. Before you pay, we show the price of the pack in pesos (or your local currency), including IVA or other applicable taxes. Each booking shows its cost in dalias and the equivalent amount in pesos. [Electronic invoices (CFDI) are available on request in Mexico.]
  • What dalias are. Dalias are a limited, revocable licence to use amarre’s booking service. They are not money, a deposit account, electronic payment funds or a virtual asset. They have no cash value and cannot be exchanged for cash, except where the law requires a refund.
  • Personal and non-transferable. Dalias belong to your account only. You cannot give, sell, lend or transfer dalias to another user or account, and you cannot pay another person’s share of a booking.
  • Expiry. Dalias you buy do not expire. They stay in your account for as long as your account is open. [If you offer promotional dalias: Promotional or bonus dalias may expire; we will show the expiry date when you receive them, and we use them first.]
  • Refunds of purchases. Purchases of dalias are final, and unused dalias are not refunded. The only exceptions are where the law gives you a right to a refund (see Section 13) or where we made an error. Purchases through Apple or Google are also subject to their refund processes.
  • Closing your account. If you delete your account, any unused dalias are cancelled and are not refunded, except where the law requires a refund. Before you confirm deletion, we will show you your remaining dalias balance. If we terminate your account, Section 14 applies.
  • Errors and fraud. We may correct a dalias balance that is wrong because of a technical error. If a payment is reversed or charged back, we may deduct the related dalias and pause bookings until it is resolved.
  • Changes. We may change the price of dalias packs or the dalias cost of bookings for the future. Changes never affect dalias you already hold or bookings already confirmed.

12. Booking a date

What you are paying for. The dalias you commit to a booking pay for amarre’s reservation and coordination service: arranging the time slot with a partner venue, confirming both attendees and managing check-in. amarre does not guarantee that the other person will attend, the quality of the venue, or the outcome of the date.

How a booking works.

  1. One user proposes a partner venue and time slot.
  2. Each person confirms and commits their own booking deposit in dalias. Each person pays only their own share. The booking is confirmed only when both deposits are committed.
  3. At the venue, each person checks in using [the QR code / in-app check-in]. Check-in is how we confirm attendance.

What happens to your dalias.

What happensYour dalias
You both attend and check inBoth deposits are used to pay for the service
You attend; the other person does notYour deposit is returned to your balance
You do not attend; the other person doesYour deposit is kept by amarre as a no-show fee
Neither of you attendsBoth deposits are kept as no-show fees
Either of you cancels more than 24 hours before the bookingBoth deposits are returned
You cancel less than 24 hours before the bookingTreated as your no-show
The venue is closed, cannot seat you, or refuses the agreed perkBoth deposits are returned

A no-show fee compensates amarre for the reservation and coordination it provided and exists to encourage everyone to show up. Forfeited dalias are kept by amarre; they are not returned to your balance or converted into credit. It is never paid to the other user. If you attend and your date does not, you get your own deposit back.

Attendance disputes. If you believe a booking was settled incorrectly (for example, check-in failed), report it within [48 hours] in [Booking > Report a problem]. We will review check-in records and venue confirmation and tell you our decision, which you can appeal under Section 8.

Venues and perks. Partner venues are independent businesses. Any perk shown on a booking (for example, a welcome drink or appetizer) is offered and provided by the venue, under the conditions shown when you book. You pay the venue directly for anything you order; amarre is not a party to your purchases at the venue and does not handle payments to venues. If a venue fails to honour a booking or perk, report it and we will return your deposit as described above.

Alcohol. Many venues serve alcohol. Drink responsibly and follow local law; venues may refuse service and may ask for ID.

Cancelling or changing. You can cancel or ask to reschedule in [Booking > Manage]. Rescheduling requires both people to agree.

14. Ending this agreement

You can stop using amarre and delete your account at any time. We may suspend or terminate your account if you break these Terms, if the law requires us to, or to protect users. We will tell you why (see Section 8) unless we cannot for legal or safety reasons. If we terminate your account, pending bookings are cancelled and the deposits of other users are returned. Your unused dalias are cancelled and are not refunded, except where the law requires a refund. Sections 6 (licence for content already shared), 15–19 and anything that by its nature should survive will continue after termination.

15. Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available.” We do not guarantee that you will find a match, that a date will take place, that the Service will be uninterrupted or error-free, or that other users are who they say they are. We do not conduct criminal background checks unless stated in Section 7. Nothing in this Section excludes rights or guarantees that cannot be excluded under the law where you live, including the Australian Consumer Law, EU consumer law and the Mexican Ley Federal de Protección al Consumidor.

16. Limitation of liability

To the extent permitted by law, amarre will not be liable for indirect, incidental, special, consequential or punitive damages, or for the conduct of any user or venue. Our total liability to you for any claim is limited to the greater of (a) the amount you paid us for dalias in the 12 months before the claim, or (b) [US$100 / equivalent in local currency].

This limitation does not apply to liability for death or personal injury caused by our negligence, fraud, wilful misconduct, gross negligence, or anything else that cannot be limited by law. EU and UK consumers: we are liable for foreseeable losses caused by our breach of these Terms.

17. Indemnity

To the extent permitted by law, you agree to compensate amarre for claims, losses and reasonable legal costs arising from your breach of these Terms or your conduct towards other users or venues. This does not apply to EU consumers or where local law prohibits it.

18. Resolving disputes

Please contact us first at [support@amarre.app]; most issues can be solved quickly.

  • Mexico: you may file a complaint with PROFECO. Disputes will be resolved by the competent courts of [Zapopan/Guadalajara, Jalisco], without prejudice to any other jurisdiction you are entitled to as a consumer.
  • United States, arbitration: Except for small-claims cases and claims for intellectual-property infringement, you and amarre agree to resolve disputes through individual binding arbitration administered by [the American Arbitration Association under its Consumer Arbitration Rules]. You and amarre waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration agreement by emailing [optout@amarre.app] within 30 days of first accepting these Terms. If this section is found unenforceable, disputes will go to the state or federal courts of [county, state].
  • European Union/EEA: you may bring claims in the courts of the country where you live. You may also contact your national consumer authority or data protection authority.
  • Australia: you may bring claims in the courts of your state or territory, and contact the ACCC, your state consumer agency, the OAIC (privacy) or eSafety (online harm).

19. Governing law

These Terms are governed by the federal laws of Mexico and, where applicable, the laws of the State of Jalisco. If you are a consumer in the EU/EEA, Australia or a US state whose law requires it, you also keep the protection of the mandatory laws of the place where you live.

20. Changes to these Terms

We may update these Terms to reflect changes in the law or the Service. For material changes, we will notify you in the app or by email at least [30] days before they take effect and ask you to accept them again. Changes never affect bookings already confirmed. If you do not agree, you can delete your account before they take effect, and Section 11 applies to your unused dalias.

21. General

These Terms, the Privacy Notice and the Community Guidelines are the entire agreement between you and amarre. If any part is unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms; we may transfer ours to a successor in connection with a merger or sale, with notice to you.
